These terms cover your use of fishtown.dev. The site is run by Fishtown Development, a software studio in Philadelphia. In these terms, "we" and "us" mean Fishtown Development. By using the site, you agree to these terms. If you do not agree, please do not use the site.
General information only
This site describes the services we offer and the work we have done. It is general information. It is not professional, technical, legal, accessibility or compliance advice for your business. Talk to us, or to a qualified adviser, before you rely on anything here for a decision.
Nothing here is an offer or a contract
Nothing on this site is an offer, a quote or a contract. Sending a form, writing to us, or talking with us does not create an agreement. Any engagement with us is governed only by a written agreement signed by both sides. If anything on this site differs from a signed agreement, the signed agreement controls.
We do not publish a price list. Any price, estimate, timeline or scope we describe, on the site or in early conversation, is indicative until it is set out in a signed agreement.
Our work pages describe past projects
Our work pages and case studies describe projects we built and what those sites do. They show past work for specific clients in specific situations. They are not a promise or guarantee that we will get the same results, numbers or outcomes for you.
Client names, logos, screenshots and website content shown on our work pages belong to those clients or their owners. We show them with permission, to describe our work. They are not ours to license, and these terms give you no right to use them.
FitKeyOS and /doors
The FitKeyOS page describes a product we make, and the /doors page points to it and to our website work. The screens on the FitKeyOS page are sketches of a fictional sample studio. The names, classes, bookings and figures on them are examples, not real customer data, and not a promise of results. Features, availability and terms for FitKeyOS are set only in a signed agreement.
Our content
Except for client material described above, the content of this site, including its text, design, code, graphics and the Fishtown Development name and logo, belongs to Fishtown Development. You may view and share links to our pages. You may not copy, republish or reuse our content or branding without our written permission.
Acceptable use
When you use this site, you agree not to:
- scrape, harvest or bulk-download content or data from the site;
- send false, misleading or automated form submissions, or use the forms to send spam;
- try to get into areas of the site you are not invited to, including the password-protected preview area;
- upload or send malware, or try to disrupt, overload or probe the site or its systems;
- use the site in a way that breaks the law or harms others.
Links to other sites
This site links to sites we built for clients and to other products and services. We do not control those sites, and we are not responsible for their content, their availability or their privacy practices. A link is not an endorsement of everything on that site.
No warranties
THE SITE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not promise that the site will always be available, free of errors, or up to date.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, FISHTOWN DEVELOPMENT, ITS OWNERS, TEAM AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR BUSINESS, THAT COMES FROM YOUR USE OF THIS SITE OR YOUR RELIANCE ON ANYTHING ON IT. These terms do not limit liability that the law does not allow us to limit. They also do not change anything in a signed agreement between you and us, which has its own terms.
Indemnity
If you misuse this site or break these terms, you agree to cover the costs, losses and claims that result for Fishtown Development, its owners and team, including reasonable legal fees.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law rules. Any dispute about these terms or this site will be heard in the state or federal courts located in Philadelphia County, Pennsylvania, and you agree to those courts' jurisdiction.
General
If a court finds part of these terms unenforceable, the rest stays in effect. If we do not enforce part of these terms at one time, we can still enforce it later. How we handle information you send us is covered in our Privacy Policy.
Changes to these terms
We may update these terms. When we do, we will change the date at the top of this page. If you keep using the site after a change, you accept the updated terms.
